The High Court of South Africa has dismissed a legal challenge by APM Terminals BV (APM), affirming the awarding of a 25-year contract to International Container Terminal Services, Inc. (ICTSI) for the development and operation of Durban Container Terminal 2 (DCT2).
The court found that state logistics firm Transnet SOC Limited acted within its legal discretion and followed principles of fairness and transparency in the tender process. It also ruled that APM’s challenge was filed with undue delay and confirmed that ICTSI’s financial qualifications met the necessary criteria, with solvency ratio not being the sole measure.
ICTSI welcomed the decision and reiterated its commitment to delivering long-term value and operational excellence in partnership with Transnet at DCT2.
The ruling comes amid strong financial performance by ICTSI. The port operator reported a 15 percent year-on-year increase in net income to US$483.84 million for the first half of 2025. Adjusted for one-off items, net income attributable to equity holders rose 20 percent. Second-quarter net income rose 16 percent to US$244.31 million, while revenue from port operations grew 14 percent to US$1.51 billion in the first half.
ICTSI also reported handling 6.99 million twenty-foot equivalent units (TEUs) during the period, marking an 11% increase over the same period in 2024.
