    Law review seeks to modernize, better protect small-scale miners


    The Department of Environment and Natural Resources (DENR) is undertaking a series of initiatives to formalize small-scale mining operations and recognize its role in the industry. 

    The initiatives form part of a review of laws with the goal of modernizing industry standards and increase the protection of small-scale miners.

    Carlos Primo David, DENR undersecretary, said the initiatives promote responsible, inclusive and globally competitive mining practices and ensure the welfare and protection of small-scale miners.

    David also assured that the initiative will be progressive with a step-by-step approach to formalization, with the ultimate goal of integrating small-scale miners into the broader mining sector.

    Data from the Mines and Geosciences Bureau show 53 declared Minahang Bayan in the country as of end-2022.

    A Minahang Bayan is a common area where small-scale miners are allowed to legally operate.

    The government aims to better monitor and regulate them for the revenue potential and safety of both miners and the environment.

    Of the 53 Minahang Bayan, 17 are in Luzon, three in Visayas and 33 in Mindanao.

    Of this number, 44 are gold, seven are chromite, one for magnesite and another one silica quartz mining.

    Legal recognition of small miners helps them get support to operate within established standards and safety protocols, the DENR said.
